Counterfeiting crime offenses include a person who intentionally traffics in goods or services and knowingly uses a counterfeit mark on or in connection with such goods or services. It also includes a person who traffics in labels, patches, stickers, wrappers, badges, emblems, medallions, harms, boxes, containers, cans, cases, hangtags, documentation, or packaging of any type or nature.
Offenses also include goods or services knowing that such good or service is a counterfeit military good or service the use, malfunction, or failure of which is likely to cause serious bodily injury or death, disclosure of classified information, impairment of combat operations, or other significant harm to a combat operation, a member of the Armed Forces, or to national security. Counterfeiting crimes also include trafficking of a counterfeit drug.
Penalties for counterfeiting crimes include a fine of no more than $2,000,000 or imprisonment of no more than 10 years, or both. For a second or subsequent offense an individual shall be fined no more than $5,000,000 or imprisoned no more than 20 years, or both.
